Ready-to-Use Loan for Use Agreement Template

A loan for use agreement records the free, temporary transfer of an asset from its owner to another person. This ready-to-use template helps identify the property, set the duration and permitted use, allocate maintenance responsibilities, and establish return conditions clearly.

A loan for use agreement, also known as a gratuitous loan or commodatum, allows an owner to let another person use property without charging rent. It is useful for real estate, vehicles, equipment, furniture, or other assets that must be returned after a defined period or purpose. A written agreement helps both parties identify the item, avoid misunderstandings, and record the conditions of use. This template is designed as a practical starting point that can be adapted to the applicable law and the nature of the property.

What Is a Loan for Use Agreement?

A loan for use agreement is a contract under which the lender delivers a non-consumable asset to the borrower for temporary use free of charge. The borrower must preserve the asset, use it only as agreed, and return the same asset when the agreed term ends or the stated purpose has been fulfilled.

Unlike a lease, this arrangement does not involve rent. If the user pays regular consideration for possession or use, the relationship may instead be treated as a lease or another type of contract under local law.

Common Uses

This agreement is commonly used when family members, friends, companies, or nonprofit organizations allow another party to use a house, room, vehicle, tool, machine, or office equipment without payment. The written document is particularly important when the asset is valuable or when use will continue for several months.

Essential Information to Include

Clear identification of the parties and the property is the foundation of the agreement. Include full legal names, contact details, the asset description, its condition at delivery, and any inventory or photographs attached to the contract.

Useful Supporting Records

For property such as a dwelling or vehicle, attach a signed handover report. It may list keys, meters, accessories, existing damage, documents delivered, and photographs, reducing disputes about the condition at return.

Responsibilities of the Parties

The lender should deliver the property in a usable condition and disclose known defects that could cause harm or prevent ordinary use. The borrower should take reasonable care, keep the asset secure, comply with agreed restrictions, and notify the lender promptly of damage, loss, or serious repair needs.

  • Use the property only for the agreed personal, residential, or operational purpose.
  • Keep the property reasonably clean and protected from avoidable damage.
  • Do not transfer possession, subloan, or sublet the property without written consent.
  • Pay ordinary running expenses if the agreement assigns them to the borrower.
  • Return all keys, accessories, documents, and the property itself at the end of the loan.

Term, Early Return, and Termination

The agreement should state a fixed end date, a defined purpose, or a clear mechanism for requesting return. It should also address whether the lender can request early return because of breach, urgent personal need, misuse, or another legally permitted reason.

Include a reasonable notice procedure where appropriate. If the property is real estate, local housing and property rules may impose formal requirements or limit how possession can be recovered, even where no rent is charged.

Practical recommendation: document the property's condition at delivery and return with dated photographs, a signed inventory, and meter readings where relevant.

How to Complete the Template

Review every blank field before signing and ensure that all attachments are clearly identified. Each party should receive a complete signed copy, including inventories, photographs, and any written consent for special uses.

  1. Identify the lender, borrower, and any authorized representatives.
  2. Describe the property precisely and attach a condition report if needed.
  3. Set the permitted use, loan period, expenses, and maintenance duties.
  4. Sign and date the agreement, then exchange complete copies.

Frequently Asked Questions

Is a loan for use agreement the same as a lease?

No. A lease generally requires payment for the right to use property, while a loan for use is usually free of charge. The legal classification can depend on the actual arrangement and local law.

Can the borrower lend the property to someone else?

Not unless the lender has given permission, preferably in writing. Unauthorized transfer of possession may be a breach of the agreement.

Who pays for repairs and running costs?

The agreement should distinguish ordinary expenses from major repairs and unexpected damage. Applicable law may impose additional responsibilities depending on the type of property and the circumstances.
