Ready-to-Use Lease Agreement Template with Guarantor

This ready-to-use lease agreement with guarantor template helps landlords and tenants record the main rental terms while adding a third party who undertakes to guarantee the tenant’s obligations. It includes spaces for the property details, rent, term, deposit, guarantor undertaking, notices, and signatures.

A lease agreement with a guarantor records the conditions under which a landlord lets a property to a tenant and identifies a third person who supports the tenant’s obligations. The guarantor is commonly asked to cover unpaid rent, property damage, or other contractual liabilities if the tenant does not comply. A clear written agreement helps all parties understand the scope and duration of that commitment. Before signing, the document should be reviewed against the law that applies where the property is located.

What a lease agreement with a guarantor covers

This document combines the usual terms of a residential or commercial tenancy with a guarantee undertaking. It should identify the landlord, tenant, guarantor, premises, rent, payment dates, lease term, security deposit, and rules for use of the property.

The guarantee clause must be written carefully because it defines whether the guarantor is liable only for rent or for all obligations arising from the lease. The parties should avoid relying on oral promises, particularly where the guaranty is intended to continue after renewal or extension of the tenancy.

Who is the guarantor?

A guarantor is an individual or organisation that agrees to be responsible for specified tenant obligations if the tenant fails to perform them. Landlords often request one when a tenant has limited credit history, insufficient income, or no local rental record.

Essential information to include

Accurate party and property details reduce disputes and make it easier to deliver notices or enforce the agreement. The lease should also state the governing law and any mandatory local rules that cannot be excluded by contract.

Document fieldPurposeCommon error
Property addressIdentifies the premises being leasedLeaving out unit, floor, or parking details

Security depositRecords the amount and permitted deductionsIgnoring local deposit protection requirements
Guarantor liabilityDescribes what the guarantor must coverUsing vague wording about the liability limit

Defining the guarantee

The agreement should say whether the guarantee is limited to a maximum sum, a fixed period, or particular obligations. It should also state whether the guarantor remains liable if the tenancy is renewed, varied, assigned, or extended, subject to applicable law.

Key checks before signing

Each party should have sufficient time to read the entire agreement and receive a complete copy. The landlord should verify the identity and contact details of the tenant and guarantor, while the guarantor should understand the financial risk before making a commitment.

  • Confirm the full legal names and current addresses of all parties.
  • Describe the property, included furniture, appliances, and parking spaces accurately.
  • State the rent, due date, payment method, and any permitted charges.
  • Set out the deposit amount and the conditions for its return.
  • Specify the precise scope, duration, and any monetary cap of the guaranty.
Practical recommendation: give the guarantor a final copy of the lease and any later written amendment, and obtain written acknowledgement of receipt.

How to complete the template

Complete the variable fields before printing or signing. If a clause is not applicable, delete it or mark it clearly rather than leaving uncertain blank spaces.

  1. Enter the location, date, and identification details of the landlord, tenant, and guarantor.
  2. Insert the complete property description, rental period, rent, and deposit information.
  3. Choose the intended scope of the guarantor’s undertaking and state any limit clearly.
  4. Review the completed document, attach any inventory, and have every party sign and retain a copy.

Rental rules vary substantially by jurisdiction. Local law may regulate notice periods, rent increases, repairs, deposits, habitability, eviction procedures, discrimination, and the enforceability of guarantee terms.

For this reason, the parties should check the rules of the state, country, or municipality where the premises are located. A lease term that conflicts with mandatory law may be unenforceable even if every party signed it.

Frequently asked questions

Can a guarantor be liable for property damage?

Yes, if the guarantee wording covers damage, repair costs, or other tenant obligations, and if that scope is enforceable under the applicable law. The document should specify the obligations covered.

Does the guarantor need to sign the lease?

The guarantor should sign a written guarantee or the lease itself to evidence informed consent. Some jurisdictions impose formal requirements for guarantees, so local rules should be checked.

Can the guarantee continue after the original lease term?

It can, but continuation should be stated expressly and may depend on local law. A guarantor should not assume that a renewal, extension, or variation is automatically covered.
