Ready-to-Use Accommodation Liability Waiver Template
This accommodation liability waiver template helps property owners, hosts, and guests record the terms of a stay, including property rules, responsibility for damage, personal belongings, emergencies, and compliance with applicable regulations. It is suitable for short-term or temporary accommodation arrangements.
An accommodation liability waiver is a written document used to clarify responsibilities between a host or property manager and a guest. It can set out the rules for occupying the property, handling damage, using facilities, and responding to emergencies. A carefully drafted form helps reduce misunderstandings by recording what each party has agreed to before or at check-in. It should be adapted to the type of accommodation and the law governing the arrangement.
What an accommodation liability waiver covers
This document is commonly used for holiday lets, guest houses, temporary lodging, hosted stays, and other short-term accommodation. It identifies the parties, the property, the dates of stay, and the core rules that apply during occupancy.
It may also address responsibility for damage caused by the guest or their visitors, the care of keys and access devices, prohibited activities, and the host's limits of responsibility where permitted by law.
Liability limitations and legal boundaries
A waiver cannot always remove liability, particularly where injury, fraud, gross negligence, unsafe conditions, or statutory consumer rights are involved. Its wording should therefore be reasonable, clear, and consistent with mandatory local rules.
Key details to include
The form should describe the accommodation precisely and avoid vague obligations. Include the booking period, maximum occupancy, emergency contacts, and any rules that are important to the safe use of the property.
| Document field | Purpose | Common error |
|---|---|---|
| Property address | Identifies the accommodation covered | Using an incomplete address or omitting the unit number |
| Stay dates | Defines the period of guest responsibility | Failing to state check-in and check-out times |
| Guest details | Identifies the person accepting the terms | Listing only a nickname or booking profile name |
| Damage obligation | Explains responsibility for loss or damage | Not describing how damage will be assessed |
| Emergency procedure | Provides instructions for urgent events | Leaving out local emergency contact information |
Guest responsibilities during the stay
Guests should be asked to use the premises responsibly, follow safety instructions, and ensure that their visitors also comply with the stated conditions. If a security deposit is used, the related terms should be disclosed separately and clearly.
- Use the accommodation, furniture, and appliances with reasonable care.
- Comply with occupancy limits, house rules, and quiet-hour requirements.
- Report damage, hazards, malfunctions, or lost keys promptly.
- Keep personal valuables secure and do not leave the property unsecured.
- Pay for losses or damage caused by the guest or their visitors, subject to applicable law.
Personal property and valuables
The document may state that guests remain responsible for their personal belongings, but it should not attempt to exclude rights that cannot legally be waived. Hosts should also take reasonable measures to maintain safe premises and secure any property entrusted to them.

How to complete and sign the form
Both parties should read the terms before signing. The guest should receive a copy, whether in paper or electronic form, together with any house rules and check-in information incorporated by reference.
- Enter the full names and contact details of the host and guest.
- Describe the accommodation, booking dates, and permitted occupants.
- Review the liability, damage, safety, and conduct clauses with the guest.
- Sign and date the form, then keep a copy with the booking records.
Use plain language and give guests sufficient time to read the terms before arrival or check-in; a signature is more reliable when consent is informed and documented.
Practical drafting considerations
Do not use a generic waiver as a substitute for property maintenance, insurance, or legally required disclosures. The wording should match the actual services provided and should not promise rights or protections that the host cannot deliver.
For accommodation involving children, pools, parking, shared facilities, pets, or higher-risk activities, consider adding specific rules and obtaining advice on appropriate insurance and local compliance requirements.
Frequently asked questions
Does a signed waiver protect a host in every situation?
No. Enforceability depends on the wording, the circumstances, and the applicable law. Certain liabilities and statutory rights may not be excluded or limited.
Should every adult guest sign the form?
It is generally useful for the booking guest to sign. Depending on the arrangement and local law, a host may also request signatures from all adult occupants.
Can this form be used for long-term residential tenancies?
Not without careful adaptation. Long-term tenancies are often subject to specific mandatory tenancy laws, notices, deposits, and rights that differ from short-term accommodation arrangements.
